An interesting note from an ex-Hellerite who worked in the San Diego office:
The California DLSE sent out wage claim hearing notices to several ex-Hellerites about a hearing on February 10, 2009. This, understandably, has caused some confusion since now Heller is in bankruptcy and all court actions are stayed as well as administrative actions such as wage claims.
It appears that the notices from DLSE were sent out just before they were notified of the bankruptcy filing. So, in short, the hearings will not take place on February 10 and DLSE will send out updated notices to those who filed wage claims in the San Diego area.
Finally, this answers a question many have had: should I file a wage claim with CA DLSE? Most of those asking have not been following Heller Highwater for several weeks which is understandable what with the holiday season, looking for employment, etc.
The answer is: don’t bother filing a wage claim since it will be rejected on the basis of Heller having filed a Chapter 11 bankruptcy petition. Stay stuned on how and when to file a Proof of Claim with the bankruptcy court – this will be your best bet in recovering hopefully all of the money owed to you.
