We are class counsel for the certified class of former Heller Ehrman employees seeking unpaid wages from the bankruptcy estate. This is an update on the upcoming additional distribution of money to former Heller Ehrman employees.
On September 12, 2011, the Court granted Heller’s motion asking the Court to approve paying out over $20 million to creditors (which includes employees). Heller’s motion included some general information about the claim percentages to be paid (i.e., 24 to 33 percent), but Heller now says the distribution will be 30 percent. Heller has filed the list of employees (and how much money each will get) under seal. This is to protect employee privacy. Heller has sent every employee a letter stating how much money that individual employee can expect to receive.
Heller had previously stated that it hoped to make the payments by September 15, 2011. We are trying to get updated information on the status of the payments.

Would someone explain why it wasn’t clear that not all employees would be receiving money? Did I overlook something? That’s all I’m looking for.
After reading the documents again, it just states filing a list of employees and the amount they will receive. I think we all assumed that each of us would be receiving some payment.
I assumed as well, but, for example, if your only claim was for vacation, and you had less vacation time accrued than the 6-month limit for priority claims, then you may have nothing left (other than waiting time penalties that I do not believe would be paid out under this).
So does this payment constitute the end of the class action lawsuit against Heller Ehrman and no further payments are due to us?
Any updates on payment timing?
This says that we were supposed to have received a letter indicating what we could expect to receive. I haven’t received it yet. Has anyeone?

Yes, I received mine sometime in August. I also work with 3 former Heller emp’s and they received theirs the same day that I did.
Yes, when are we supposed to receive the exact amount that we are owed via correspondence? 30% doesn’t mean anything.
Got my check today!
I got one of the letters in, August I think, but have not gotten a second letter. Should I? Has anyone else gotten their checks?
