Your Help Is Needed – Employees Committee

We  need your help!! The US Trustee’s office has formed an Unsecured Creditors Committee as part of the bankruptcy process but they have failed to appoint an ex-Heller Ehrman employee.  We run the risk of not having a voice in this process, and of having to seek individual attorney representation if needed.  

The next step is to urge the US Trustee’s office to form an Employees Committee which will allow us to have a voice on our claims and our issues involved with those claims.

Dear Ms. Loo:

I am writing as a former employee of Heller Ehrman LLP, debtor in Bankruptcy Petition #: 08-32514.  I, like over 700 other ex-Heller employees, am owed a substantial amount of money for wages, accrued vacation and other items some of which constitute a priority claim.

Despite the appearance of ex-Heller Ehrman employees at the January 5, 2009 meeting to form an Unsecured Creditors Committee, there currently is no such representation by ex-employees.  As a group, we have – as Debtor has stated – at least $20 million in claims which taken as a whole make us the third or fourth largest creditor in the case.  Despite having millions of dollars of claims as a group, it is financially burdensome for the individual employees (many of whom have not found substitute employment or earn a modest wage in their new jobs) to independently retain bankruptcy counsel.

There are many issues involved with the ex-employee claims and I am writing to urge you that an Employees’ Committee be formed by the US Trustee’s office as soon as possible so the employees have an adequate voice in the process.  Our main concern, besides having our voices diminished or dismissed during the process, is the lack of clear communication from the Debtor to what once was its greatest asset: its employees.  An example is the error-filled List of Verified Creditors submitted by Debtor on December 29, 2008 which has omitted hundreds of ex-employees and includes others who were terminated over a year ago.

It is imperative that this committee be formed as soon as possible to address the needs of the ex-employees of Heller Ehrman as creditors.

I appreciate your attention to this matter.  Thank you.
