Updated Docket Sheet – Everyone’s Gettin’ Fat ‘Cept . . .

. . . the ex-employees of Heller Ehrman. Quelle suprise, no?

I’ve posted an updated Docket Sheet over in the Bankruptcy section today.  Please keep in mind that this is a partial docket sheet and only lists activity from May 1 through August 10, 2009.

Besides mention of the Second Interim Status Report Filed by Creditor Committee Official Committee of Unsecured Creditors on August 7, 2009, there are some interesting entries:

  • August 3, 2009 – Withdrawal of Claim #823 by PNC Real Estate Finance.  The original claim was in the amount of $10,500,000.  Anyone have more info on this and the basis for the original claim? Was there a settlement of the claim with PNC?
  • August 3, 2009 – There is a hearing on Monday, August 17, 2009 at 1:30 pm PDT in Courtroom 22 regarding Notice of Debtor’s Motion for Order Authorizing Assumption of Certain Licenses, Contracts and Leases Relating to the Debtor’s China Offices Pursuant to 11 U.S.C. Section 105(a) and 365(a).
  • June 26, 2009 – Debtor’s Motion for Order (I) Authorizing the Debtor to Assign Certain Licenses, Contracts and Leases Relating to the Debtor’s China Offices to Winston & Strawn LLP Pursuant to 11 U.S.C. Section 105(a) and 365(f)(2), and (II) Approving Reconciliation of Various Bank Accounts, Expenses and Deposits in Connection Therewith.
  • July 29, 2009 – Ex Parte Application for Order Authorizing the Debtor to Transfer Employee Benefit Plan Administrator Duties Under 11 U.S.C. Section 521(a)(7) to Keith Betzina Filed by Debtor Heller Ehrman LLP.
  • June 11, 2009 – Order approving motion to approve compromise of controversy with attorneys handling Unum Litigation. Anyone have info on this? I think this is related to the trial for Unum that was ongoing during the implosion and the ex-Heller attorneys put out their own money to ensure the clients were properly represented – correct?

    …But Bank of America, besides getting a big fat federal bailout check from the current admin, gets paid before any Heller employee? Even the ones that facilitated the migration of every single shareholder in the office?

    Looking back, and knowing what we have learned now, it’s pretty clear that this manipulation of the books was a scheme devised mainly by Matt, Barry and Phyllis. I think the majority – and I mean about 95% – of the shareholders were unaware of their shenanigans. I think it is shocking that a handful of myopic leaders can slam an iconic and historical firm to pieces in 18 months – and – still deny any responsibility for it!!! Did anyone else notice that only Matt issued another idiotic statement to the press? Like, ya, we’re going to believe anything he says! It just really pisses me off when I think how we all scrimped “for the firm”, only to find out now that firmwide management was fucking with the numbers, cooked the books, took the money, and ran. And continuing in their ad naseum delusional reasoning, blame everyone else – the banks, the attorneys that were leaving the sinking ship, the failed mergers, etc., the “economy” for the failure of the firm, I hope now the truth is obvious to the rest of the world. I would hope that in order to save a shred of dignity or decency, the “Estate” will at least come through for all us employees, not just with the meager minimum amount due to us, but the full compensation that includes interest and penalties. That would save their reputation greatly. Hopefully Matt will pull his head outta his ass and admit it in so many words to the press. Maybe a cold day in hell is coming sooner rather than later.

    This will haunt the guilty people who are at fault. This was clearly done by choice, no one told them to do this but themselves. They don’t feel remorse because they don’t care about anyone else but themselves. Pure selfish. The thrill has past and now it will bite them back in the ass, it comes back around. It always does. Wait and see.

    Matt Larrabee is talking in this week’s The National Law Journal. The article is entitled “After the Fall” He’s now going to be in charge of expanding Dechert’s business on the West Coast. Watch out Dechert!!!

    Larrabee, et al, had a tragic propensity for bumbling and stumbling their way through corporate America. Gekko, on the other hand, was a polished Mephistopheles. I’d say Heller management was tragically and desperately misguided and underprepared in its attempts to be a major player at any cost and, therefore, is much more similar to Bud Fox.

    Believe me, there was plenty of advice given freely to the “big wigs” but all of it was snubbed and jeered at. They were an elite group of know-it-alls that would not listen to advice from anyone, except of course, the consultants they paid $10-$20K to get advice from. It’s so disgusting. But it’s so psycho that none of them will take any responsibility. Isn’t that something like being a sociopath?

    It is called betrayal, and what we feel is betrayed, lied to and cheated. Whether you were an attorney or staff, we trusted our leaders in management to do the right thing. They sadly did not honor that trust. If anything, we have this site to commiserate with our former coworkers who share in our hurt. And if we do get anything back, then hopefully all of us will move on a little quicker.
